Securade Software Terms of Service
Effective Date: 1 January 2024
Welcome to Securade! These Terms of Service (“Terms”) govern your use of the Securade software, including the website, web editor, mobile applications, and associated services (“Services”). By accessing or using our Services, you agree to these Terms. If you do not agree with these Terms, you may not use the Services.
- Acceptance of Terms
By creating an account or using the Services, you agree to be bound by these Terms, including any additional terms and policies incorporated by reference.
- Eligibility
You must be at least 18 years old to use the Services. By using Securade, you represent and warrant that you have the legal capacity to enter into these Terms.
- Account Registration
To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities that occur under your account.
- Use of Services
Securade grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for legitimate purposes. You agree to use the Services in compliance with all applicable laws and regulations.
- User Responsibilities
You agree not to:
- Misuse the Services or interfere with their functioning.
- Use the Services for any unlawful or harmful activities.
- Upload or share content that infringes on intellectual property rights or violates others’ privacy or rights.
- Attempt to access restricted areas of the Services without authorization.
- Intellectual Property
All content, trademarks, and intellectual property associated with the Securade software remain the exclusive property of Securade or its licensors. You are granted no rights to use these except as expressly permitted by these Terms.
- Payment and Subscription
If you purchase a subscription or other paid services, you agree to provide valid payment information and authorize us to charge applicable fees. Subscription plans and billing policies may be subject to change, and any changes will be communicated to you in advance.
- Termination
We may terminate or suspend your access to the Services at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Services. You may also terminate your account at any time by contacting us at support@securade.co.za.
- Warranty Disclaimer
The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied. Securade disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability
To the maximum extent permitted by law, Securade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Services;
- Unauthorized access, use, or alteration of your data;
- Any conduct or content of any third party on the Services.
- Indemnification
You agree to indemnify, defend, and hold harmless Securade and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
- Changes to the Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.
- Governing Law
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
